FITNESS FOR A PURPOSE : Micropower Computer Services Ltd, (The Company ) makes no representations or warranties with respect to any Software or Hardware, and specifically disclaims any express or implied warranties of merchantability, title, or fitness for a particular purpose unless agreed in writing by a Director of The Company.

RETENTION OF TITLE : Notwithstanding delivery and the passing of risk, all goods shall be and remain the property of Micropower Computer Services Ltd., until all monies relating to such goods are paid in full. Should any goods have to be recovered by the company then access to those goods shall not be impeded by the purchaser.

CONSEQUENTIAL LOSS OR DAMAGE : The Company will not be liable for lost profits or revenue, loss of use of Software or Hardware, loss of data, costs of recreating lost data, the cost of any substitute equipment or program any loss or damage of whatsoever nature or to whomsoever caused arising out of the use of goods supplied hereunder. Micropower Computer Services Ltd strongly recommends a backup be made before any Software is installed. Technical support for this Software may be provided at the discretion of Micropower Computer Services Ltd.

PRICES : Catalogue prices are an indication only. The Company reserves the right to reject any orders in full or in part where prices differ from those prices unless such prices are agreed in writing by a Director of The Company.

DELIVERY : Time for delivery of goods is not of essence unless agreed in writing by a Director of The Company.

PRODUCT WARRANTIES : In the case of defects or faulty workmanship in products or any parts supplied but not manufactured by The Company, the customer shall not be entitled to receive any greater benefit hereunder than shall be received by the seller under any guarantee or warranty given to The Company by the manufacturers or suppliers thereof.

SHORTAGES IN SUPPLY : Claims for discrepancies in goods supplied must be made within TWO working days from the receipt of any such goods.

RETURN OF GOODS : All goods are supplied on a 'Firm Sale' Basis and no returns will be credited except by prior written agreement.

ENGLISH LAW : These conditions and any contracts between the parties shall be constructed and applied in accordance with the law of England and the English Courts shall have sole jurisdiction in any dispute relating hereto.
